Values Exchange Community Terms of Use

1. Eligibility

Membership of the Values Exchange Community is void where prohibited by law.

You warrant that:

  1. all registration information you submit is truthful and accurate;
  2. you will maintain the accuracy of that information;
  3. you will keep any password supplied to you secure;
  4. you are a legitimate member of the institution which subscribes to this Values Exchange
  5. your membership and use of the Values Exchange Community does not violate any applicable law.

2. Content

VIDe Ltd. (owner of the Values Exchange Community) does not claim any ownership rights in the text, files, images, photos, video or any other materials (Content) that you post on the Values Exchange Community.

You warrant that:

  1. you own Content posted by you on the Values Exchange Community; and
  2. the posting of your Content on the Values Exchange Community does not violate the privacy, intellectual property rights or any other rights of any person.

When posting Content you must:

  1. treat the views of other members with respect;
  2. not use any obscene, indecent, threatening or offensive language;
  3. not post any Content that may be defamatory, obscene, an infringement of intellectual property rights, discriminatory, misleading or deceptive or otherwise unlawful; or
  4. not post a photograph or video of another person without that person’s consent.

Content may be moderated by VIDe Ltd. However, Content is not generally moderated prior to its appearance and VIDe Ltd. accepts no responsibility for the conduct of any user or member of the Values Exchange Community, including any Content posted on the Values Exchange Community by a staff member.

VIDe Ltd. reserves the right to remove any Content.

3. Use

You must not use the Values Exchange Community to:

  1. bully, intimidate or harass any user;
  2. misrepresent or defame others;
  3. commit fraud;
  4. collect usernames or email addresses of members by electronic or other means for the purpose of sending unsolicited email;
  5. engage in misleading or deceptive conduct; or
  6. propagate computer worms, viruses or other types of malicious programs.

You may report any concerns about or misuse of the Values Exchange Community by email on [email protected].

4. Liability

VIDe Ltd. is not responsible for the conduct, whether online or offline, of any user or member of the Values Exchange Community.

In no event will VIDe Ltd. or any Institution which subscribes to the Values Exchange Community be liable to you or any other person for any damages, losses, costs or expenses arising from your use of the Values Exchange Community or any Content.

You indemnify VIDe Ltd. for any damages, losses, costs and expenses incurred by VIDe Ltd. arising out of your use of the Values Exchange Community.

5. Intellectual Property

The subscribing Institution – or if there is no subscribing Institution, VIDe Ltd., owns the intellectual property rights in all Content posted on the Values Exchange Community. Nothing in these terms of use confers on you or any member any ownership rights in that intellectual property.

6. Termination

VIDe Ltd. may do any of the following:

  1. delete your profile;
  2. delete any Content posted by you; and
  3. terminate your membership, for any reason.

These terms apply to all people who register to participate in the Hear Our Voices Values Exchange.  By registering, you agree to abide by these terms of use.  In these terms, "We", "us", and "our" are references to Save the Children New Zealand and VIDe Limited and "You" and "your" are references to you.  We may change these terms from time to time and, by continuing to use Hear Our Voices Exchange, you agree to any such changes.  We will post a notice on the Hear Our Voices Values Exchange when we change these terms.

Registration

Registration on the Hear Our Voices Values Exchange is open to all persons.  When you register for the Hear Our Voices Values Exchange, you promise that the name, age and contact details given are correct.  If you are under the age of 18, then you must get the consent of your parent(s) or guardian(s) prior to agreeing to these Terms of Use.  Each person may only register for the Hear Our Voices Values Exchange once.  

All personal information provided on registration will be held by Save the Children and VIDe.  Such personal information will be kept confidential and will only be collected, used and disclosed in accordance with our Privacy Statement. 

Once you register on the Hear Our Voices Values Exchange, you must keep all usernames and passwords secure and confidential and must not disclose them to any third party.  You are responsible for any actions taken through your membership.  We may suspend, terminate, or reject your membership (including your logon and/or the connection of your hardware device) without notice and without entering into discussions with you.  Without limiting the foregoing, we may suspend or terminate your membership if a serious complaint or multiple complaints are received about you from other members, if you breach these Terms of Use, if you impersonate another member, or if we, at our sole discretion, deem your behaviour to be unacceptable.  Members who have registered under multiple aliases will have all of their aliases disabled.  If we suspend or terminate your membership, you must not create another one without our prior approval. 

Your Use of Hear Our Voices Exchange

You agree to use the Hear Our Voices Values Exchange in a manner that complies with all applicable laws, and that does not infringe our rights, nor the rights of anyone else, nor restricts or inhibits other's use and enjoyment of the Hear Our Voices Values Exchange.

You agree to only post content that you own on the Hear Our Voices Values Exchange.  In posting such content, you agree to:

      1. treat the views of other members with respect;
      2. not use any obscene, indecent, threatening or offensive language;
      3. not post any content that may be defamatory, obscene, an infringement of intellectual property rights, discriminatory, misleading or deceptive or otherwise unlawful; 
      4. not post a photograph or video of another person without that person's consent; and  
      5. SCNZ using this content to inform its work on children and young people in New Zealand.  SCNZ will always cite comments anonymously in any SCNZ publications.

While participating in the Hear Our Voices Values Exchange you must not:

      1. bully, intimidate or harass any other user;
      2. misrepresent or defame others;
      3. engage in misleading or deceptive conduct; 
      4. commit fraud;
      5. collect usernames, email addresses or other information about members by electronic or other means for the purpose of sending unsolicited emails or other communications;
      6. propagate computer worms, viruses or other types of malicious programs;
      7. take friendships with strangers offline; or
      8. misrepresent yourself in any way

We may remove, modify, or decline to publish comments or content, if we, in our sole discretion, consider them to be inappropriate, unlawful or that they otherwise breach these Terms of Use or any additional terms.   We may also, if we consider that a breach of these Terms of Use has occurred, send you a warning, limit, suspend or cancel your access to the Hear Our Voices Values Exchange or warn others about your actions.  

Intellectual Property

Save the Children New Zealand owns all intellectual property rights in the Hear Our Voices Values Exchange.  This includes all of the content of the Hear Our Voices Values Exchange (such as text, graphics, logos, icons and sound recordings).  VIDe Limited own all software code underlying and forming part of the Hear Our Voices Values Exchange.  

You may view, save, copy and print any part of the Hear Our Voices Values Exchange for your personal use only.  You may not otherwise use, copy, modify, or distribute any part of the Hear Our Voices Values Exchange.  If you have any questions about what you may or may not do, you can contact Save the Children New Zealand on [email address].

When you post or upload any content to the Hear Our Voices Values Exchange or makecontact with other users of the Hear Our Voices Values Exchange:

      1. you agree that any content may be viewed, saved, copied or printed by other users of the Hear Our Voices Values Exchange for their personal use;
      2. you agree that any such content may be used, copied, distributed or disclosed by us at any time in any form and for any purpose; and
      3. you warrant that you own any intellectual property rights in such content.

Our Liability

We are not responsible for the conduct, whether online or offline, of any user or member of the Hear Our Voices Values Exchange.  You are responsible for all content that you post on the Hear Our Voices Values Exchange, even though we may sometimes moderate that content.  We are not liable, in any situation, to you or any other person for damages, losses, costs or expenses arising from your use of the Hear Our Voices Values Exchange.  By using the Hear Our Voices Values Exchange, you agree to indemnify us, and keep us indemnified, from and against all actions, claims, costs (including legal costs and expenses), losses, proceedings, damages, liabilities, or demands suffered or incurred by us to any person arising out of your breach of these Terms of Use or your use of the Hear Our Voices Values Exchange.

If any provision of these Terms of Use become or is held to be illegal, invalid or unenforceable in any respect, that provision shall be read down to the extent necessary to make it legal, valid and enforceable or, if it cannot be read down, be deemed severed from these Terms of Use.  Neither such change shall affect the legality, validity and enforceability of the other provisions of these Terms of Use.

The Hear Our Voices Values Exchange and these terms are governed by the laws of New Zealand.  When you access the Website, you submit to the non-exclusive jurisdiction of the New Zealand courts.

Our commitment to privacy

Your privacy is important to us.  Subject to the terms of this Privacy Statement, you can use the Hear Our Voices Values Exchange and remain entirely private.  

The personal information we collect

When you register we collect:

  1. your first and last names; 
  2. your email address; and
  3. if you choose to fill them out, your gender, age and school.  

This information will be held by Save the Children New Zealand, which has its registered office at Level 3, 204 Willis Street, Wellington, New Zealand, and VIDe Limited, which has its registered office at 17 Elsfield Place, Torbay Heights, North Shore City, New Zealand.  

When you post content on the Hear Our Voices Values Exchange, you may use just your first name, or a pseudonym.  However, in accordance with the Terms of Use, the name the email address you provide when you register must be correct.  

Who has access to the information we collect

Save the Children New Zealand and VIDe Limited, the joint managers of the Hear Our Voices Values Exchange, have access to the information which we collect.  

How we will use the information you post on the Hear Our Voices Values Exchange

The information you post on the Hear Our Voices Values Exchange will be used by Save the Children New Zealand to:

  1. gain a better understanding of the issues that affect children and young people and the solutions that they think might work to address these challenges;
  2. inform government and policy makers what young people in New Zealand think about a variety of social issues; and
  3. support the changes that we want made by the New Zealand government and society in order to strengthen the protection and wellbeing of our children and young people.

Our privacy promise

We will keep all of your personal information.  This means we will never give or sell your email address to anyone.  

We will never reveal any of your personal information to anyone, except:

  1. your first name or pseudonym, as used publicly by you on the Hear Our Voices Values Exchange;
  2. where we are required to do so by law; or
  3. in accordance with the provisions of the Privacy Act 1993.  Specific instances where your personal details may be disclosed in accordance with the Privacy Act 1993 are where we believe disclosure is necessary to prevent or lessen a serious and imminent threat to the life or health of you or any other person, or where we believe disclosure is necessary to avoid prejudice to the maintenance of law, including the prevention, detection, investigation, prosecution and punishment of offences (i.e. where we believe that a criminal offence has been or is going to be committed).  For more information on the Privacy Act go to www.privacy.org.nz.  

 If we decide that we do need to disclose your personal details under (2) or (3) above, we will contact you prior to doing so, unless we consider, in our sole discretion, that for any reason it would not be practicable to do so.
